- Meta Description: The details of Ben Mshish's assassination, the fate of his killer Ibn Abi al-Tawajin, and a jurisprudential study on martyrdom from Hisn al-Salam.
Introduction
The martyred Qutb Moulay Abdelsalam Ben Mshish is considered one of the most prominent pillars of Moroccan and universal Sufism, and the source of the Shadhili spiritual path that filled the horizons. However, the historical, political, and jihadist dimensions of this great figure's life have often been obscured by superficial and superstitious popular narratives.
In this documented research, extracted from the book "Hisn al-Salam" by the historian and researcher Taher El Lhioui, we unveil rare pages (from page 420 to 435) that investigate the family and agricultural life of the Sheikh. It uncovers, through historical records, the dimensions of the despicable conspiracy led by foreign entities to end his life at the hands of the false prophet and charlatan Ibn Abi al-Tawajin al-Kitami, followed by a profound jurisprudential study on the concept of assassination, wrongful killing, and the status of martyrs in Islam.
The Spiritual Lineage of Qutb Moulay Abdelsalam Ben Mshish in Divine Knowledge
He took the Sufi path from his first Sheikh and mentor since his youth, the righteous saint and Knower of Allah, Sheikh Abd al-Rahman al-Madani. The latter learned from the Knower of his time, the Qutb Taqi al-Din, who called himself "Taqi al-Faqir" (using the diminutive form for both), who was from the land of Iraq. He learned from Qutb Fakhr al-Din, from Qutb Nur al-Din Abi al-Hasan Ali, from Qutb Taj al-Din, from Qutb Shams al-Din in the land of the Turks, from Qutb Zayn al-Din al-Qazwini, from Qutb Abi Ishaq Ibrahim al-Basri, from Qutb Abi al-Qasim Ahmad al-Marwani, from Qutb Abi Muhammad Said, from Qutb Saad, from Qutb Abi Muhammad Fath al-Su'ud, from Qutb Said al-Ghazwani, from Qutb Jabir, from the first of the Qutbs Abi Muhammad al-Hasan ibn Ali, from his father Ali ibn Abi Talib, from the Messenger of Allah, peace and blessings be upon him. This was mentioned by the grandson of Sheikh Abi al-Hasan al-Shadhili, may Allah have mercy on him.
It was said that Sheikh Sidi Abd al-Rahman al-Madani learned from Sheikh Abi Ahmad Jafar ibn Abdullah ibn Ahmad ibn Sayyid Bunah al-Khuza'i al-Andalusi, from Sheikh Abu Madyan and others. This is plausible because Sheikh Abu Madyan died in the year 594 AH at around 85 years of age. However, what is stated in "Al-Yawaqit al-Asriyyah" by Al-Muwaqqit al-Marrakushi is that he died in 580 AH, and his disciple Sheikh Abu Ahmad ibn Sayyid Bunah died in 624 AH at about 100 years of age. Accordingly, he would have met his Sheikh for a period of 60 or 70 years, lived after his Sheikh for about 30 or 40 years, and would have coexisted with Sheikh Moulay Abdelsalam for about 17 or 22 years, and with Ibn Sayyid Bunah for about 24 or 46 years, while his own lifespan was 63 years. Therefore, it is permissible that Sidi Abd al-Rahman al-Madani learned from Sheikh Ahmad ibn Sayyid Bunah through Jafar ibn Abdullah from Sheikh Abu Madyan because they were contemporaries. Sheikh Abu Madyan's burial place is in Mount Tlemcen at a place called Ribat al-Abbad in the land of Algeria. Sheikh Abu al-Abbas al-Mursi, may Allah have mercy on him, said regarding the path of Sidi Abd al-Rahman al-Madani: It is connected to the Qutbs, transmitted from man to man up to Al-Hasan ibn Ali, from his father Ali ibn Abi Talib, from the Prophet, peace and blessings be upon him.
Daily Life and Agricultural Activity of Sheikh Ben Mshish
May Allah have mercy on him, he had chosen his residence in a place where an ancient village had vanished long ago called "Adyaz al-Fawqani," below his shrine from the western side at a distance of two miles. It is said that the people of the village moved and settled near it where they are today. As for his life, he lived on agricultural production, relying on two estates (Azibs); one in the district of Wamras, where a house attributed to him still stands today. This district is located in the village of Abi Zuhri, which is about ten miles from his place of residence. The other is located near the land of Ayyasha at the bottom of the tribe of Bani Arous, about 55 miles away, and is called (Abu Mahdi). Its traces remain there to this day, including a water spring attributed to him with abundant water. The ruins of his house and some graves used to exist alongside the mosque, until this was altered by the deputy of the commander, Mr. Al-Mufaddal Al-Tajarti, when he moved his residence there after the independence era and built a house for himself at the mentioned site, disregarding these historical monuments. Near the village is also the site of his worship on stones. It is narrated that during his stay in the mentioned village, he used to perform Friday prayers at the Rmeila Mosque from the Al-Khatut faction in the tribe of Bani Jarfat, which is about six miles from the mentioned estate. Near the mentioned estate is an elevated place topped by an ancient wild tree surrounded by a stone enclosure (Hawsh) attributed to the mother of Sheikh Moulay Abdelsalam, called the station of "Lalla Zohra." Most of the land in these plains is owned by the descendants of Sheikh Moulay Abdelsalam to this day, inherited through fathers and grandfathers, except for those who sold their shares.
From this, you learn that the Sheikh, may Allah have mercy on him, relied in his life on agricultural production, just as the people of his time lived. The Sheikh was not entirely secluded in worship throughout his life as some imagine. Rather, it appears through his deeds that he divided his life into three stages: he dedicated the first stage to scholarly life, the second stage to engaging with children and jihad, and the third stage to devotion and worship. In this final stage, he chose to reside on the mountain where he is now, in a village far from urbanization, until he passed away in the place where he remains buried to this day.
His Death as a Martyr
It was by the decree and predetermination of Allah that his genius was only completed by his death as a martyr, so that he would be: "with those whom Allah has blessed of the prophets, the truthful, the martyrs, and the righteous. And excellent are those as companions." He passed away before the dawn prayer on the morning of Saturday in the year 622, and it was said 623, 624, 625, or 626 AH, at the age of 63. He was buried at the peak of the mountain at the site where he remains today, and it was called Jebel al-Alam (The Mountain of the Flag), so this name became predominantly used for this mountain where the Sheikh is buried.
The genealogists agreed to attribute to him everyone who inhabited it from the children of the righteous saint Sidi Abu Bakr ibn Ali, the collective ancestor of the Alami lineage. Thus, anyone whose lineage traces back to Abu Bakr outside the tribe of Bani Arous is called "Alami," and this name is not applied to their cousins, the Idrisids, even if they lived with them on Jebel al-Alam.
It happened on the day the mentioned Sheikh was martyred that his Sheikh, the righteous saint Sidi al-Hajj Ahmad Aqtran, a lover of the Prophetic Household, came to visit the shrine of the righteous saint Sidi al-Hajj Musa al-Rada ibn Jaysh, the brother of the mentioned Sheikh. So, on the morning of that day, he headed with a group of notables to his grave for the purpose of praying for him, and among them was the son of the Sheikh, Shahood, and one of the sons of the visited Sheikh, Sidi Sulayman, nicknamed Abu Bakr. When they began reciting Surah (Ya-Sin) and reached the words of the Almighty: "This is what the Most Merciful promised, and the messengers told the truth," they saw a sign reflected upon them in the form of a rainbow. They wondered at this and looked at each other, and it almost distracted them from reciting. However, the son of the Sheikh whose father's grave they were visiting turned to them, telling them to continue. They read until they completed the Surah, read Al-Fatiha after it, and kept repeating: "O Allah, O Ever-Gentle, we ask Your gentleness in what the decrees have brought."
As they were about to leave, a person they did not know came to them and informed them of the death of the martyred Sheikh. They rushed in bewilderment and shock to the scene of the incident, a distance estimated at ten miles. They found the mentioned Sheikh slaughtered and drenched in his blood above the spring known as Al-Baraka. This was the spring where the Sheikh used to perform ablution and ascend from it to his private quarters at the peak of the mountain, which is known today among the common folk as the Mosque of the Angels, and the place is known today as Al-Manazah. Next to the mosque is the cave of the Sheikh, which was suitable for sitting and sleeping, over which a fresh water tank has been built today, which then distributes to specific places. Then his mentioned Sheikh undertook his washing, shrouding, and praying over him, and he was buried at the site where he is today, in the presence of his children, his brother's children, his cousins, and all others in attendance. The place of his washing and shrouding remains preserved to this day below the shrine, close to it. This structural reality indicates definitively that matters were natural and contained none of the supernatural anomalies claimed by popular fabricators and charlatans, except that near the location lie "Maqtalat al-Abd" (The Killing Place of the Slave) and "Aqabat al-Hayya" (The Serpent's Pass), and the common folk add and subtract regarding the reasons for these names, and Allah knows best. There are other accounts by those fond of narrating oddities that have no foundation and merit no attention.
The Cause of His Murder: The Leader Moulay Abdelsalam Ben Mshish
Different accounts have been reported regarding the motive behind his murder, but no one disagreed that his killer was Ibn Abi al-Tawajin al-Kitami, the false prophet and sorcerer. Among these accounts is what was stated in Al-Kawakib, quoting Ibn Khaldun: that the cause of his death was due to a female jinn who used to accompany him and inform him of the conditions of the people coming to him. One day, she came to him in extreme pain and said to him: "You will not see me after today, because I ascended this mountain and was confronted by the light of Ben Mshish, which destroyed me." This amplified his rage, so he resolved to kill him and sent someone who assassinated him—a tale that strongly resembles a myth.
Another account claims that his murder was instigated by the Almohads because he used to denounce them, saying to them: "You consume the worldly life in the name of religion." This holds no truth either, because he fought alongside the Almohad army in the land of Andalusia as previously mentioned, and resided with them in the city of Ceuta. When the news of his murder spread, a detachment of the Ceuta garrison marched against Ibn Abi al-Tawajin, as will be detailed later.
It was also said that Ibn Abi al-Tawajin was a governor for the Almohads over Tangier and its surrounding area, and a dispute occurred between him and the Sheikh that led to his murder. This is also groundless, because it was not easy for someone like Ibn Abi al-Tawajin, who practiced alchemy and what they claimed to be sorcery, to hold a position as a governor in that Islamic era, where positions were granted to men of religion, seriousness, and merit, not to charlatans like Ibn Abi al-Tawajin.
It was also said that Ibn Abi al-Tawajin sensed the weakness of the Almohad state in their wars against the Marinids, and his whims tempted him to claim prophecy and practice charlatanship and corruption on earth through murder and adultery. Therefore, some who wrote about him called him the Kitami False Prophet. This saying is closer to being plausible due to its alignment with his traits of sorcery, corruption, and attracting the misguided among the simple-minded and wicked un-employed, who aided him in his purpose, approved of his doctrine, and followed him in it. All these accounts are purely speculative.
What we have discovered recently, which is supported by analytical insight, is that his murder was instigated by Catholic Christians through Spain with the participation of Rome. They were monitoring his movements even during the jihad in Andalusia. It is said that his surveillance was carried out by Catholic priests and churchmen who knew a great deal about his affairs and were waiting for an opportunity. Perhaps the ambush that forced him out of the city of Ceuta was engineered by them, and then they repeated the attempt after his settlement at Jebel al-Alam on a larger scale than the first, at the hands of the forsaken charlatan Ibn Abi al-Tawajin, creating a precise blueprint that he executed to the end.
Ibn Abi al-Tawajin and His Despicable Conspiracy
Most historians who wrote about him mentioned him by his famous title and did not mention a name or lineage for him, though it was said that his name was Muhammad. They made him famous by the name derived from his practice of alchemy and his use of numerous clay pots (Tawajin) to boil plants and mineral materials necessary for his trade. Thus, a title was derived for him from this profession and used until he became famous by it, which is "Abu al-Tawajin" (The Father of Pots). It was originally a title for his father who practiced this trade, and after his father's death, he adopted his profession, so it became an inheritance to earn a living through it. Therefore, he was given his father's title and called "Ibn Abi al-Tawajin." His hometown was the village of Kitama, located within the borders of the tribe of Al Srif from the side of the tribe of Rahona. For this reason, some historians mentioned him with the lineage of Al-Srayfi. His residence was in Ceuta, and after this village, the city of Ksar el-Kebir was named Ksar Kitama.
Execution of the Crime
Documents were found in the Escorial Library in Spain proving that the murder of Sheikh Moulay Abdelsalam was at the hands of the Christians. We do not doubt this because his movement, his departure from Ceuta, and his heading towards it after executing the crime are definitive proof of that, though fate overtook him during his journey to it. It is evident through his movement that it was according to a precise blueprint. As for sorcery, he used to hide behind it to conceal his affair until he achieved the intended purpose, which he did. He left the city of Ceuta accompanied by a group of unemployed rabble, among whom were some Christians, then headed to his hometown, the village of Kitama. Then he left it and settled in a place called Al-Khabrasha from the village of Budha of the Yusufi tribe. He chose for his emergence the discord between the Almohads and the rising Marinids coming from the desert of Algeria. He exploited the suitable circumstances for that, which were that Morocco was in a transitional period, the situation in Andalusia with the Spaniards was deteriorating, and the Almohad sheikhs were in a state of appointing and deposing governors in order to find a competent man among them, as the search was conducted in complete darkness for the person fit to lead the two shores.
While they were in that state, they were surprised by the Marinids emerging against them from eastern Morocco. The authority of the Almohad sultan began to shrink backward, leaving Morocco divided between the Marinids and the Almohads. The eastern Morocco detached from them, and nothing remained in their hands except the Atlantic coasts from the city of Marrakesh to Ceuta. At the head of the Marinids, undertaking their leadership, was Abu Said Uthman ibn Abd al-Haq al-Marini, known among the common folk as the Black Sultan because his mother was Abyssinian. It is not hidden from anyone who knows the nature of nations what happens to the affairs of the common folk regarding raiding, looting, and highway robbery in such circumstances. Uthman ibn Abd al-Haq al-Marini raided the land of Ghazaz and the nomad Zenata tribes therein in the year 620 AH, inflicting heavy losses upon them until they submitted to obedience, and he restrained them from harming people through raiding and looting. In the year 621 AH, he raided the people of Azghar and the land of Al-Habt among the Riyah Arabs, inflicting heavy losses upon them until he nearly decimated them, and that was before his allegiance was finalized. Thus, Morocco became divided between them; the Marinids gained the tribes of Hawara, Zakara, Tsoul, Miknasa, then Ghiyata, Ghashtala, then Sadrata, Bahlula, and Madyuna, so he distributed his governors over them and imposed taxes upon them, just as he imposed them on his cities that were loyal to him, which were Taza, Fez, Meknes, and Ksar Kitama, and they used to pay it at the end of each year in return for restraining raids against them and securing their paths.
After these victories obtained by the Marinids due to the weakness of the Almohad sultan and the disruption of their affairs, nothing remained in their hands except the Atlantic coasts. Their caliph in Seville at that time from the Andalusian shore was Abu al-Ala Idris al-Ma'mun ibn Yaqub al-Mansur al-Muwahhidi. When he received news of his brother Abdullah who was in Marrakesh, nicknamed Al-Adil, and the turmoil he was in with the Almohad sheikhs, he claimed the caliphate for himself in Seville, so he was pledged allegiance there, and most of the people of Andalusia answered him, and he took the title Al-Ma'mun. The Almohad sheikhs in Marrakesh pledged allegiance to him after they strangled his brother Abdullah al-Adil in a water vat. After they sent the allegiance to Al-Ma'mun and the courier departed from them, they regretted it, broke their allegiance, and then made another pledge to Yahya ibn al-Nasir ibn al-Mansur. This caused concessions to the Spaniards under conditions regarding key cities of Islamic Andalusia in return for seeking the assistance of their army, which was estimated at 12,000 soldiers. This was the first Spanish army to enter Morocco, so Al-Ma'mun fought Yahya, defeated him, and seized the city of Marrakesh, and he was the first to give the Spaniards a free hand in building churches in the land of Morocco.
During this dark atmosphere of events and calamities, the enemy of Allah, Ibn Abi al-Tawajin, slipped in and assumed the claim of prophecy, cloaked in sorcery through what he displayed to the common folk of converting lead into silver and copper into gold by means of alchemy. He was followed in his sorcery and corruption by a group of misguided, unemployed youths from the common rabble who had no morals. The first to go out with him from the city of Ceuta were people from the children of Al-Haysho, and others went out with him from his village, Kitama. After he chose his settlement in Al-Khabrasha from the village of Budha, a great multitude gathered around him there. His prophetic, sorcerous call was a cover from the ruling politicians so that they would not pay attention to him. Among the factions that followed him, and remnants of their descendants still remain to this day, are: Awlad al-Hamama, Awlad al-Yamama, Awlad al-Rabuz (who are famous as his supporters), Awlad al-Haysho, Awlad al-Tanahra, Awlad al-Fasi, Awlad Shahbun, and Awlad al-Bakakra. It was said of him that when his followers multiplied, he began to impose upon every village the right to commit adultery with their virgins. He stayed in this tribe, whose location is not further from the station of the Qutb than about thirty miles. It has been revealed that during his stay, he was plotting the execution of the heinous crime in assassinating the mentioned Qutb, executing the desire of those who instigated him. If it were not a planned scheme, it would have been possible for them to attack him in his own home among his family and clan, as the Sheikh was not prepared for war and defense, and the population on the mountain was very scarce, but the precise plotting was safer for assassinating him than all of this.
A detachment composed of ten followers ambushed the Leader in his path to his private summer prayer site at the peak of Jebel al-Alam, because they had prior knowledge of his conditions, knowing that he used to leave his house in the village of Adyaz al-Fawqani—his residence and the residence of his family and cousins—in the last third of the night or about an hour or two before dawn, enough for dawn to overtake him while he was in his mosque. It was said that he used to perform ablution on his way to his mentioned prayer site from the spring called to this day Ayn al-Baraka, above which he was found killed by about 100 meters. There is no doubt that he was heading to his mentioned prayer site known as the Mosque of the Angels, and at the spot where he was killed, he was washed, shrouded, and buried where he is until now, and the places of his shrouding and washing remain preserved to this day.
When he resolved to execute the crime, he moved with those of his followers who were with him and entrusted ten of them with the assassination of the mentioned Sheikh. So they went out before him while he was behind them waiting for the return of the news. They went and fulfilled what he had entrusted to them, seized the neck of the mentioned Qutb, slaughtered him, and killed him. Then Allah sent upon them a thick fog that led them astray from the path, and they were pushed down from cliffs, falling into deep abyss where their bodies were torn to pieces, and not a single informant returned from them.
The End of the Criminal Ibn Abi al-Tawajin in the Tribe of Bani Said
As for the miserable, accursed enemy of Allah, he proceeded with those who remained with him in their wake, seeking his way towards his headquarters in Ceuta along the foot of the mountain until he verified the execution of the crime. After verifying its execution, he wanted to take a path passing through the tribe of Bani Badr, so a detachment of its men came out against him, preventing him from passing through their land and territory. When he inclined to the foot of Jebel al-Alam and passed through the land of the tribe of Bani Layth, he stayed at a house there, and they hosted him and honored him. Then he continued his journey to the tribe of Bani Hassan, and it was said that they welcomed him and sheltered him. Then he continued his journey to the neighboring tribe of Bani Said and settled on the borders at the village of Sharudha and pitched his tent there. This tribe, despite its small size and scarcity of men, has the toughest men among the mountain tribes, generation after generation.
When Allah willed the end of this criminal charlatan, fates threw him into this tribe of heroic men, as if he were seeking his own destruction. He thought that those of the corrupt rabble who were with him would protect him so that he could continue violating the honors of Muslims as he did in other tribes he passed through. He began to demand the virgins of this tribe to commit adultery with them, so a beautiful girl from the family of Awlad Ghazaka was described to him, and he demanded her. She had a beautiful young brother who was a student of Islamic knowledge (Taleb) from among the preservers of the Holy Quran, and he was proud and brave, refusing humiliation for his family. He consulted with his companions and family regarding assassinating the enemy of Allah, so they secretly agreed upon that and invited to their opinion everyone who was protective of his sanctuary and honor. Their opinion concurred on killing him and pursuing the vile ones among his followers. The mentioned youth volunteered for that, armed himself with a sharp dagger under his clothes, and was presented as a gift instead of his sister after they adorned him with the jewelry of girls and beautified him with their attire. They presented him to him in the name of his sister, so he liked him, rejoiced in him, and entered him into his private tent. When night fell, he wanted him, and the youth began to resist him after showing his joy in him, becoming more active and pleased with what he was doing. He stipulated that if he wanted to possess her, he must fulfill two conditions: stripping off the coarse clothes except for a light garment, and extinguishing the lamp. When he began to take off his clothes, the youth went and extinguished the lamp, then drew the dagger from his belt and stabbed him with a blow that managed to eliminate him, so he uttered a horrible cry heard by the men of the conspiracy who were monitoring its success.
When the mentioned youth came out, his rabble supporters were defeated and fled, so they pursued them; some were killed and some escaped, fleeing for their lives until they took refuge with the tribe of Bani Hassan, which found among them those who protected the fugitives from the followers of the accursed one. A garrison from them came to carry the body of the accursed one to bury him among them, but the tribe of Bani Said prevented them from that, and they disputed among themselves until fighting almost broke out over his body because the tribe of Bani Said swore to burn his body, while those from Bani Hassan prevented them from that. They sought judgment from one of the judges of the neighboring tribe of Bani Zajjal, who gave them a fatwa to cook him in a large pot of water and then dump his flesh for the others. So they cooked him to satisfy Bani Said, then dumped his flesh for those who buried him inside the borders of the tribe of Bani Hassan where he is, near the village of Sharudha on the passing road between them. Since that time, his grave has been a famous latrine for everyone who passes by it to urinate and defecate on his grave, and this has continued until now across seven centuries of time. The people of the land of Bani Said and others from the people of those lands mention that if you are passing on your way by the grave of this accursed one and reach his grave, you feel an immediate urge to relieve yourself over it.
[Field Note by the Historian Taher El Lhioui]:
"On 16 Sha'ban 1415 AH / March 14, 1995 AD, I reached it, stood over it, and stoned his grave with three stones. The location of his grave is on a public road in the neighboring village of Bani Hazzaz. His grave is a garbage dump among small Thuja trees, and at a distance on an elevated spot is an inhabited house for the people of the village. To the left of El Lhioui in the field is a single-room house, about 15 meters away, and on his grave is a rock used by school students."
After the news of the murder of Sheikh Moulay Abdelsalam reached the governor of Ceuta, he dispatched a detachment of its soldiers to fight Ibn Abi al-Tawajin. When they reached the kasbah of Tetouan, the news reached them that one of the Berbers had assassinated him in the tribe of Bani Said, so they returned to their camp. As for the fate of his followers, every one of them returned to his country, and remnants of these wicked rascals, supporters of sorcery and corruption, still remain in the tribe of Bani Yusuf—which used to be called Bani Makth—to this day, and disbelief and polytheism are still the character of their deeds until now. Some said concerning Ibn Abi al-Tawajin after he killed Ben Mshish, may Allah have mercy on him:
<center>
If there were any good in you, O enemy of mankind... you would not have been nicknamed the son of the father of pots
You came early to assassinate the Qutb of the West and the East entirely... the descendant of Mshish from the best of the virtuous
And their house in glory is an elevated house... tracing back to Hasan, of precious noble origins

The Occurrence of a Pagan Custom
Among the corrupt pagan customs is what was introduced by the supporters of the accursed Ibn Abi al-Tawajin since ancient times, especially if the year was plagued by drought and rain was withheld. The ignorant folk among the people of this tribe collect large donations and buy a bull or two with the intention of slaughtering it at the shrine of Qutb Moulay Abdelsalam. Upon leaving the tribe, they accompany those who remain of the descendants of the followers of Ibn Abi al-Tawajin from their tribe, carrying loads of lime manufactured in their lands, and they come to the shrine of the mentioned Sheikh. After presenting what they have of gifts and slaughtering the animal, the supporters of Ibn Abi al-Tawajin come forward, climb the wall of the shrine, and descend to the holy grave on the grounds that they are his enemies. They take what they find there of money and candles thrown by some visitors into the middle of the shrine, intending that the righteous saint should know them as his enemies and hate them, and then ask Allah to take revenge on his enemies with heavy rain that kills them on their way when they return to their homes. After leaving the shrine, they prepare the lime and invalidate all the existing walls there. They said, and the text of the issues stated that, so the sky sent upon them its heavy rains for several years, so much so that in some years some of them would perish as a result of the heavy rains and severe hail, thinking that this was a revenge from Allah for His saint, the mentioned Sheikh. This is a pagan custom, a corrupt belief, and polytheism against Allah.
This custom has confirmed several things to us: among them that this tribe was a den for betraying the saint of Allah, that some factions of the supporters of Ibn Abi al-Tawajin are still present there until now, that it proves the enmity of their ancestors to this righteous saint, and that the proximity of the place helped him execute his mission and his despicable conspiracy. It also confirmed his death in the tribe of Bani Said while heading towards his headquarters from which he emerged in Ceuta. It was within his capacity from his stay in the mentioned tribe after executing the crime to enter with his sorcery into the tribes of the south and penetrate them, and perhaps find a market for his sorcery, prophecy, and charlatanship, but he walked according to what was plotted for him so that he would return to his headquarters in Ceuta in the end. The enemy of Allah did not take into account that his end would be in the tribe of Bani Said, where there were only about 70 miles between him and Ceuta, which is a one-day journey. All these clues indicate clearly that he left Ceuta with the intention of executing a drawn-up plan, then worked to apply it to the end of the intended purpose, but fate intervened between him and his wish to return to his headquarters in Ceuta and live there: "And to Allah belongs the matter before and after," there is no lord besides Him.
The Jurisprudential Understanding of Martyrdom and Types of Martyrs
Some people may think that martyrdom is a narrow scope restricted to those who sincerely fought for the sake of elevating the word of Allah and died in battle or outside it. The truth held by the scholars is that martyrdom has various states, and that martyrs vary in degrees according to their circumstances. The highest degree of martyrs is the degree of the martyr of the battlefield (Shahid al-Mu'tarak), who was singled out by Allah with privileges over the rest of the martyrs. The Almighty said: "And do not say of those who are killed in the way of Allah that they are dead. Rather, they are alive, but you do not perceive," meaning you do not know that. The life of martyrs is not known by the senses, hence manners dictate upon every believer regarding their life to say instead of "died," "he was martyred," in compliance with the words of Allah: "And do not say... the verse." The martyr in Islam is whoever is killed so that the word of Allah is the highest, and the word of those who disbelieve is the lowest, and they are those who fulfilled the contract between them and their Lord regarding buying and selling: "Indeed, Allah has purchased from the believers their lives and their properties with the condition that they will have Paradise." For they exerted what they possessed of wealth and soul in His path and seeking His pleasure, so their Lord fulfilled for them what He promised them of great success: "They fight in the path of Allah, so they kill and are killed. It is a true promise binding upon Him in the Torah, the Gospel, and the Quran. And who is truer to his covenant than Allah? So rejoice in your transaction which you have contracted. And that is the great success." This includes the privileges of martyrs and eternity in Paradise.
Allah has elevated the status of these above every status, saying: "And never think of those who have been killed in the manner of Allah as dead. Rather, they are alive with their Lord, receiving provision, rejoicing in what Allah has bestowed upon them of His bounty." It is narrated from Al-Hasan al-Basri, may Allah be pleased with him: That the martyrs are alive with Allah, their provisions are presented to their souls, so comfort and joy reach them. From Mujahid: They are provisioned with the fruits of Paradise and find its fragrance but are not inside it. And from him, peace and blessings be upon him, who said: "The souls of martyrs are in the crops of green birds that roam in Paradise wherever they wish." In another hadith from him, peace and blessings be upon him, who said: "Allah made the souls of martyrs in the bellies of green birds, frequenting the rivers of Paradise, eating from its fruits, and taking shelter in lamps suspended in the shadow of the Throne." The commentators said: As for their bodies, their place is the graves, but the souls have a connection to them, therefore no decay happens to their bodies. Their souls have a great wandering from the Barzakh to the highest heavens to the inside of paradises, and the green birds are like litters (Hawadij), while being connected to the body of their owner. The souls of martyrs are like the souls of prophets, except that the prophets are higher and more majestic.
As for the believers other than the prophets and martyrs, their souls roam from the grave to the gate of Paradise and look at what has been prepared for them of permanent bliss, but they do not enter it until the Day of Resurrection, and that is called the world of Barzakh. Its vastness relative to the worldly life is like the vastness of the world relative to the fetus in its mother's womb. In the hadith, the Prophet, peace and blessings be upon him, was asked about the grave, and he said: "The grave is a garden from the gardens of Paradise or a pit from the pits of Hellfire." In another hadith, after the questioning by the two angels, they say to him: "Sleep like the sleep of the bride." The believer has a window opened for him by the angels in his grave, so he looks through it at what Allah has prepared for him in Paradise, and its fragrance comes to him. As for the disbeliever, the angels open a window for him in his grave, so he looks through it at his place in the Hellfire, and its torment and wind come to him until the Day of Resurrection, and the disbeliever and the wicked are of the same valley.
The scholar Al-Hattab quoted from Imam Al-Qurtubi that the Sharia urged the wishing for martyrdom and encouraged it, saying: "Whoever asks Allah for martyrdom sincerely from his heart, Allah will cause him to reach the stations of martyrs even if he dies on his bed."
Among the privileges that Allah Almighty singled out for the martyr of the battlefield is that he is not washed even if he were in a state of major ritual impurity (Janaba), he is buried in his clothes in which he was martyred, and he is not prayed over. They consider that the holders of these privileges specifically are those whom the enemy kills with their weapons in battle, and their souls departed their bodies at the place where they were martyred. It is equal in that whether the enemy killed him with his hand, or he charged at them and fell into a well or fell from a cliff, or fell from his horse and his neck broke, or his arrow or sword turned back on him and killed him. Likewise, whoever is captured by the enemy and they did not grant him safety until they killed him and threw him back to us, he is not washed, shrouded, or prayed over. However, if they granted him safety and then killed him, he is washed and prayed over. If a raid occurs on some borders of the Muslims and they kill men, women, and children with weapons or without weapons, they are martyrs of the first degree; they are not washed, nor prayed over, and they are buried in their clothes, which is the well-known view. Regarding this, Sheikh Khalil said in his Mukhtasar: "And a martyr of the battlefield only is not washed, even if in the land of Islam, and even if in a state of ritual impurity according to the better view, and he is buried in his clothes if they cover him, otherwise he is supplemented with a wrap, a cap, and a belt of low value, and a ring with a small stone." The killed person in all these circumstances is a martyr of the first degree that was singled out with the previous privileges, and the remaining of blood on the martyr's body is to be a witness against his opponent on the Day of Resurrection.
The Distinction Between the Battle Martyr and the Victim of Assassination or Injustice
As for others who did not reach the degree of these, they are washed, perfumed, shrouded, and prayed over like all other dead who are not martyrs. They are those killed by assassination (Ghila); such as Umar ibn al-Khattab, Uthman ibn Affan, Ali ibn Abi Talib, and his descendant the Sheikh Moulay Abdelsalam. Included in martyrdom is whoever is killed wrongfully (Mazloum); like Uthman ibn Affan, Al-Hasan ibn Ali, and his brother Al-Husayn, and among them is the mentioned Sheikh, may Allah be pleased with them. Attached to these is whoever is killed in the battlefield but not by the hand of the enemy, such as by thieves or dissidents of opinion. Likewise, whoever the Muslims kill in the battlefield by mistake thinking he was an enemy and it turned out he was one of them. Likewise, whoever is killed by thieves while defending himself, his property, or his womenfolk, he is in all of that a martyr, but he is washed and prayed over, due to his saying, peace and blessings be upon him: "Whoever is killed defending his life is a martyr, and whoever is killed defending his property is a martyr, and whoever is killed defending his honor is a martyr," and in a narration: "and whoever is killed defending his religion is a martyr."
Among these are those trampled by horses or the like of destructive weapons in battle with the enemy and by the infantry during engagement. Among them is whoever is carried from the battlefield alive and then dies, for he is washed and prayed over. In the hadith: "Whoever dies on Friday, Allah writes for him the reward of a martyr and protects him from the trial of the grave." Among them are the victim of plague (Al-Mat'un), the one with an abdominal ailment (Al-Mabtun), the companion of pleurisy (That al-Janb), and the woman who dies during childbirth (Bi-jum'—with a damma then sukun—meaning in postpartum bleeding). Likewise, whoever is thrown by his horse or camel, or stung by a venomous creature, or dies on his bed upon any death Allah wills, he is a martyr. He who is devoured by a predatory beast; Ibn al-Teen said: "These are all deaths in which there is severity, by which Allah favored the nation of Muhammad, peace and blessings be upon him, with martyrdom to make it an expiation for their sins and an increase in their rewards, causing them to reach the status of martyrs."
Al-Hasan narrated from Al-Halwani in his Kitab al-Ma'rifah with a good chain of transmission from the hadith of Ali ibn Abi Talib who said: "Every death a Muslim dies is a martyrdom, but martyrdom varies in degrees." This is clarified by what Sheikh Jalal al-Din al-Suyuti quoted in his commentary on Al-Muwatta, saying: Al-Mat'un is he who dies in the plague. Al-Ghariq is he who dies by drowning in water. The companion of That al-Janb is what is known as a stomach ulcer, and it is called Al-Shawta, which is a tumor that occurs in the membrane lining the ribs. Al-Mabtun is the companion of diarrhea, and it was said the insane, and it was said in Al-Nihayah: it is he who dies of a disease of his abdomen like dropsy and the like, and it was said he is the companion of colic, which is the relaxation of the holding power in the anus. Al-Hariq is he who burns in fire and dies. The woman who dies Bi-jum' means postpartum bleeding, and the meaning of Jum' is that she gathered something with her, which is her child that she died with in her womb, or she is the virgin who died with her virginity, and some made the second view famous due to the large number of those holding it. The companion of tuberculosis (Al-Sall) with a kasra on the sin and a shadda on the lam. He who dies a stranger, narrated by Ibn Majah. The companion of fever, narrated by Al-Daylami. The stung, the choked, he who is devoured by predatory beasts, he who falls off his mount—and to this is applied car collisions, airplane crashes, falling from a height, and he who dies on his bed in the path of Allah, narrated by Imam Muslim. He who is killed defending his property, his blood, his religion, or his family, narrated by the authors of the four Sunan, for he in all of these is a martyr. He who is killed wrongfully, narrated by Imam Ahmad. He who dies in prison while unjustly detained, narrated by Ibn Mandah. He who dies of chaste love for the sake of Allah, narrated by Al-Daylami. He who dies while seeking knowledge for the pleasure of Allah, narrated by Al-Bazzar.
It was said in Al-Ariadah: He whom thieves kill, there is no dispute that he is a martyr. Whoever drowns in a valley or a sea during an act of highway robbery committed aggressively against passersby is a martyr, and upon him is the sin of his disobedience. Everyone who dies due to an act of disobedience is not a martyr. However, whoever dies in an act of disobedience due to one of the causes of martyrdom, he has the reward of his martyrdom and upon him is the sin of his disobedience. Likewise, if he is killed while riding a usurped horse in jihad against the enemy, he is a martyr and upon him is the sin of the usurped horse. Similar to that are people who gathered for an act of disobedience in a house and the house fell upon them; they have martyrdom and upon them is the sin of the disobedience.
It is derived from what was mentioned in these hadiths that martyrdom is of two types:
- The Martyr of this World and the Hereafter: He who is killed in war against the disbelievers, advancing and not retreating, sincere in his intention and deed, aiming by this type of approach at the face of Allah alone without any partner.
- The Martyr of the Hereafter: Those mentioned last, meaning they are given of the type of reward of martyrs but the rulings of the world do not apply to them, i.e., the privileges that Allah singled out for the first group. The reward of a martyr may be raised to twofold, like the case of Umm Khallad who came veiled asking the Prophet, peace and blessings be upon him, about her son who was killed. He said to her: "Your son has the reward of two martyrs." She said: "Why is that, O Messenger of Allah?" He said: "Because the People of the Book killed him."
The word Shahid (Martyr) is of the form Fa'il, and scholars differed regarding the reason for naming him a martyr. On the authority of Al-Nadr ibn Shumayl: Because he is alive, for his soul witnessed the Abode of Peace (Dar al-Salam), which is the paradise of Illiyyin, while the soul of others only witnesses it on the Day of Resurrection. Ibn al-Anbari said: Because Allah and His angels witness that he belongs to Paradise. It was said: Because he witnessed upon the departure of his soul what he has of honor. It was said: Because the angels of mercy witness him. It was said: Because his state witnesses to the sincerity of his intention. It was said: Because upon him is a witness of his being a martyr, which is the blood, for he is resurrected with his blood gushing. It was said: Because his blood witnesses to the pain. It was said: Because it witnesses for him with safety from the Hellfire. It was said: Because none witnesses him at his death except the angels of mercy. It was said: Because he witnesses on the Day of Resurrection to the conveyance of the messengers. It was said: Because the angels witness for him a good end. It was said: Because the prophets witness for them a good following of them. It was said: Because Allah witnesses for him his good intention and sincerity. It was said: Because he witnesses the kingdom of the abode of this world and the abode of the Hereafter. It was said: Because upon him is a witness sign that he has been saved. Some of these are specific to whoever is a martyr of this world and the Hereafter, and some include others who are martyrs of the Hereafter. Concluded from Fath al-Bari commentary on Sahih al-Bukhari.
The scholar Al-Hattab said that martyrs are three:
- The martyr of war against the disbelievers, who has the rulings of the martyr in this world and in the reward of the Hereafter.
- A martyr in the reward without the rulings of this world, who are the Mabtun and those mentioned with him.
- Whoever steals from the spoils of war, and whoever's intention was to obtain the worldly life; he has the ruling of the martyr in this world but they do not have the complete reward in the Hereafter.
If you say: How do we reconcile the two verses? His saying Almighty: "Every soul shall taste death" and His saying Almighty: "And do not think of those who are killed in the way of Allah as dead." The first verse included by its generality even the martyrs, the prophets, and the angels, and every living soul. The second verse explains that the martyrs are not dead. The answer: The soul in the first verse was expressed to mean the body, not the spirit, because the spirit does not die. It is also understood from the verse that the body of martyrs does not die. The answer to this is that the body decreed to die must be departed by the spirit, which is His saying: "Every soul shall taste death," but in the case of martyrs, it returns to it after its departure from it, so the body becomes alive with a real life. Rather, the life of martyrs is better than their first life before martyrdom, and likewise you say regarding the life of prophets and angels. As for others besides them, their souls are not returned to them except after the second blowing of the trumpet, and Allah knows best. As for what was reported in other hadiths that the spirit, after its departure from its body upon death, returns to its body so that it is questioned in its grave, after the answer they differed regarding it: it was said it remains above the grave, it was said it returns to the Barzakh and from it monitors the body from which it emerged, and it was said it is in an elevated place between the heaven and the earth waiting for its return to the body from which it emerged. The reality of the matter in that is what Allah Almighty singled out with His knowledge. (Imam) Malik was asked about it, and he said: "In front of the grave."
Conclusion and Historical Insights
The meticulous historical investigation recorded by the historian Taher El Lhioui in his book "Hisn al-Salam" provides an objective and distinct reading that removes the assassination of Leader Moulay Abdelsalam Ben Mshish from the sphere of superficial, accidental interpretation into the realm of organized geopolitical analysis. It reveals how external Crusade interests intersected with local tools of charlatanism (represented by the movement of Ibn Abi al-Tawajin) to eliminate intellectual and jihadist figures who were leading the resistance and holy garrison (Ribat) in Northern Morocco.
Furthermore, the accompanying jurisprudential conclusion reflects the depth of the Maliki school of thought in adapting the attribute of "martyrdom" to those who pass away assassinated and wronged, ensuring that the status of this great Qutb remains an eternal spiritual and scholarly beacon that transcends its geographical legacy in Jebel al-Alam to enlighten the entire human Islamic thought.
